When my ex-husband filed for divorce, I was in a panic and got a referral from a friend for an “aggressive” attorney, Barry Finkel of Fort Lauderdale, FL. I readily plunked down my retainer for his services. What I thought was confidence turned out to be annoying arrogance.
Finkel did very little to get a fair share for my case; he let a mediator handle the details of the negotiation (which I paid for separately) and then refused to do any post-judgement assistance on the case even though his billing showed a credit balance of several thousand.
Although he claims he did, Barry Finkel never provided a but does not have a signed one on file. Why would a lawyer proceed without a signed agreement with a client? I was unaware that he would keep any unused retainer once the judgement was issued – settled only 2 months after the case was filed.
Not only haven’t I collected my settlement from my ex, but now I am going to to file a civil action against my own attorney since he refuses to do any additional work without collecting more money and ignoring the credit balance on my account with him. Even though my ex is in clear violation of the Mediated Settlement Agreement and liable for court costs and attny fees, Finkel won’t “take the risk” before the judge. When I researched his other cases, I see that he has reason to be fearful of leaving empty-handed.
